These Terms of Service govern your use of the Vayro™ website and your purchase of products from Vayro™.

By accessing the website, placing an order or purchasing a product from Vayro™, you agree to these Terms of Service, together with the other policies referenced on the website.

Vayro™ operates in South Africa as a sole proprietorship under:

Nothing in these Terms is intended to exclude, restrict or waive any consumer right that cannot legally be excluded, restricted or waived under South African law.

1. About Vayro™

Vayro™ is an online retailer specialising in DIY tools, equipment, accessories and related products.

Vayro™ currently sells products to customers within South Africa only.

Nothing in these Terms limits statutory rights that cannot legally be limited.

  • packaging changes;

  • supplier updates;

  • or other circumstances outside Vayro™'s reasonable control.

Customers are responsible for determining whether a product is suitable for their particular project or application, unless Vayro™ has expressly represented that the product is suitable for that specific purpose.

Customers should review:

  • intended use;

  • operating limitations;

  • safety information;

  • and included accessories.

6. Pricing

Prices displayed on the Vayro™ website are stated in South African Rand unless otherwise indicated.

Vayro™ takes reasonable steps to ensure that displayed prices are accurate.

If an obvious pricing error occurs, Vayro™ reserves the right to correct the error and, where appropriate and permitted by law, cancel an order affected by the error.

Where an order is cancelled due to an obvious pricing error and payment has already been received, the applicable amount paid for the cancelled order will be refunded.

7. Orders

Submitting an order constitutes an offer by the customer to purchase the selected products.

An order is subject to acceptance and product availability.

Vayro™ may decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable;

  • an obvious pricing or product-description error has occurred;

  • the order contains suspicious or fraudulent information;

  • payment cannot be verified;

  • the requested delivery address cannot reasonably be serviced;

  • or circumstances arise that make fulfilment impossible.

Where Vayro™ cancels an order after payment has been received, the applicable amount paid for the cancelled order will be refunded.

8. Payment

Payment must be successfully completed through the payment methods made available by Vayro™.

Vayro™ uses third-party payment providers where applicable. Payment information may therefore be processed by the relevant payment provider according to its own systems, security measures and privacy practices.

Customers are responsible for providing accurate payment and billing information.

9. Delivery

Vayro™ primarily uses Aramex Store-To-Door for delivery within South Africa.

The standard estimated delivery timeframe for Vayro™ orders is:

8 to 11 business days.

This is an estimated timeframe and is not an absolute guarantee that every order will arrive within exactly 8 to 11 business days.

10. Delivery Delays

Delivery may be affected by circumstances outside Vayro™'s reasonable control, including:

  • courier delays;

  • weather;

  • road closures;

  • strikes;

  • public holidays;

  • remote-area delivery constraints;

  • incorrect or incomplete customer information;

  • failed delivery attempts;

  • unforeseen logistics problems;

  • or other events outside Vayro™'s reasonable control.

To the extent permitted by law, Vayro™ will not be liable for losses caused solely by delivery delays arising from circumstances outside Vayro™'s reasonable control.

This clause does not exclude any consumer right or remedy that cannot legally be excluded.

11. Delivery Address

Customers are responsible for providing a complete and accurate delivery address.

Vayro™ cannot guarantee successful delivery where the customer provides:

  • an incorrect address;

  • incomplete address information;

  • incorrect contact details;

  • an inaccessible address;

  • or other inaccurate delivery information.

Additional delivery charges may apply where a parcel must be redirected or re-delivered due to incorrect information supplied by the customer, to the extent permitted by law.

12. Returns and Refunds

Returns, refunds and exchanges are governed by the Vayro™ Returns, Refunds and Exchanges Policy.

Nothing in that policy or these Terms removes statutory consumer rights.

13. Consumer Protection Act

Vayro™ recognises the rights granted to consumers under the Consumer Protection Act 68 of 2008.

Where a statutory consumer right applies, that right will prevail over any inconsistent provision in these Terms.

14. Electronic Communications

By placing an order or communicating electronically with Vayro™, you consent to receiving transaction-related communications electronically where permitted by law.

This may include:

  • order confirmations;

  • payment confirmations;

  • shipping notifications;

  • tracking information;

  • return communications;

  • and other communications necessary to fulfil your order.

15. Website Availability

Vayro™ makes reasonable efforts to keep the website available and functioning.

However, Vayro™ does not guarantee that the website will always be:

  • available;

  • uninterrupted;

  • error-free;

  • free from technical problems;

  • or free from temporary outages.

Website availability may be affected by maintenance, hosting problems, technical failures, security incidents or circumstances outside Vayro™'s reasonable control.

16. Intellectual Property

Unless otherwise stated, content appearing on the Vayro™ website, including:

  • branding;

  • product descriptions;

  • photographs;

  • graphics;

  • written content;

  • page designs;

  • and other original content

is owned by or licensed to Vayro™ or the relevant rights holder.

You may not reproduce, copy, modify, distribute or commercially exploit Vayro™ content without permission, except where permitted by law.

17. Vayro™ Brand

Vayro™ is the trading and brand name used by the business operated by Jan Albert Brits.

The use of the "TM" symbol indicates that Vayro is being claimed as a trade mark. It does not represent that the mark is registered.

Vayro™ does not use the registered trade mark symbol "®" unless and until the relevant mark has been legally registered.

18. Prohibited Website Use

You may not use the website for unlawful or fraudulent purposes.

This includes attempts to:

  • obtain products through fraudulent payment;

  • interfere with website security;

  • introduce malicious software;

  • access restricted systems;

  • impersonate another person;

  • abuse promotional offers;

  • submit knowingly false information;

  • or interfere with another customer's use of the website.

19. Product Safety

Customers must follow all applicable product instructions and safety warnings.

Vayro™ DIY tools must only be used for their intended purposes and within their specified operating limitations.

Customers are responsible for using appropriate protective equipment where applicable.

Vayro™ may use third-party service providers, including:

  • Shopify;

  • payment processors;

  • courier companies;

  • website hosting providers;

  • email providers;

  • analytics services;

  • and other service providers required to operate the online store.

Third-party services may have their own terms and policies.

21. Privacy

Personal information collected through the website will be handled in accordance with Vayro™'s Privacy Policy and applicable South African privacy law, including the Protection of Personal Information Act 4 of 2013 ("POPIA").

22. Limitation of Liability

Vayro™ does not exclude liability where such exclusion is prohibited by South African law.

To the maximum extent legally permitted, Vayro™ will not be responsible for indirect or consequential loss arising solely from circumstances outside Vayro™'s reasonable control.

Nothing in this clause excludes liability for matters that cannot lawfully be excluded.

23. Unauthorised Use of Products

Vayro™ is not responsible for injuries, damage or losses resulting from a customer's failure to use a product according to applicable instructions, specifications and safety warnings, to the extent that such limitation is permitted by law.

This does not exclude liability that cannot legally be excluded.

24. Changes to These Terms

Vayro™ may update these Terms from time to time.

The version applicable to an order will generally be the version in effect when the order was placed, subject to applicable law.

25. Severability

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

The affected provision will be interpreted or limited to the extent necessary to make it legally enforceable where possible.

26. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

27. Complaints

Customers should first contact Vayro™ directly so that we can attempt to resolve any complaint.
